Statutes

Sherman Antitrust Act

The Sherman Antitrust Act of 1890 prescribes the rules of free competition among entities engaged in commerce. The Act broadly prohibits (1) anticompetitive agreements and (2) unilateral conduct that monopolizes or attempts to monopolize the relevant market. The Sherman Act is codified in 15 U.S.C.  §§ 1-7.

Federal Trade Commission Act

The Federal Trade Commission Act of 1914 established the Federal Trade Commission as a federal agency. ​The Act outlaws unfair methods of competition and unfair acts or practices that affect commerce. The Federal Trade Commission Act is codified in 15 U.S.C. §§ 41-58.

Clayton Antitrust Act

The Clayton Antitrust Act of 1914 supports the Sherman Antitrust Act and the Federal Trade Commission Act. The Act seeks to prevent anticompetitive practice in their incipiency by prohibiting particular types of conduct not deemed in the best interest of a competitive marketplace. Broadly, the Act focuses on principles of economic trade and business. The Act is codified in 15 U.S.C. §§ 12-27 and 29 U.S.C. §§ 52-53.​

Case Law

Antitrust Case Database (Westlaw)

This database includes cases from all federal courts that relate to antitrust law and the promotion of competition, the prevention of monopoly, and the regulation of domestic trade and commerce. Coverage begins with 1789. Westlaw requires a subscription to access this content.

Bloomberg Law Antitrust Practice Center

This database provides primary sources, legal analysis (including BNA Portfolios and Law Reports),  legal analysis, news, chart builders, practice guidance, and practice tools. The Practice Center is expansive and requires a subscription. Users are able to set alerts to receive the latest antitrust law updates. Users are able to search for administrative agency and law judge decisions on antitrust law.​

 

DOJ Antitrust Case Database 

This database is provided by the Department of Justice and it allows users to search antitrust case filings. The database lists cases alphabetically by the last name of the individual defendants, by company name, or by the entity's first name. Amicus curiae briefs are listed by plaintiff's name. Users are able to search for administrative agency and law judge decisions on antitrust law.

HeinOnline

Hein Online allows users to browse by date, retrieve by citation, search by index, or search full-text to find case law. Hein Online also publishes official reports of decisions for relevant antitrust cases including the FTC and the DOJ. All documents are available in PDF format.Documents begin in 1936 – present. Hein Online requires a subscription to access this content.

Agency Regulation and Legislative History

Regulations.gov

This website is typically used by members of the general public to provide input on proposed rules and notices before they are finalized. The site allows users to browse by agency, date, or search full-text to find proposed regulations. Documents listed are available in PDF format. Relevant agencies to federal antitrust laws are the FTC and the DOJ.

Govinfo.gov

The Federal Register provides a uniform system for publishing presidential documents, regulatory documents with general applicability and legal effect, proposed and final regulations, notices, and documents required by statute to be published. Proposed and final regulations appear first in the Federal Register. In order for any administrative regulation to be legally effective, it must be published in the Federal Register. The Office of the Federal Register (OFR) of the National Archives and Records Administration(NARA), and the U.S. Government Publishing Office (GPO) jointly administer the FederalRegister.gov website.

Agency Websites 

This website provides a list of federal agencies and their respective website. Agency decisions are typically published online. Generally, agency rules and law judge decisions are available through their respective websites. Relevant agencies to federal antitrust laws are the FTC and the DOJ.

Legislative History of Antitrust Laws

This source provides legislative history on federal antitrust laws. Legislative history documents are produced by Congress as bills are introduced, studied, and debated. These documents are often used to determine Congressional intent and to clarify vague or ambiguous statutory language.

​

FTC Competition Policy Guidance

The source provides guidance about the application of U.S. Antitrust laws to practitioners, policy makers, businesses, and consumers to promote marketplace competition. The FTC Bureau of Competition has developed educational resources aimed at consumers and businesses to prevent consumer injury, increase business compliance, and triage its enforcement efforts.

This treatise provides developments on antitrust law and procedure. This treatise provides comprehensive analyses of the development and current status of antitrust law, as well as practical guidance for the application of Antitrust Laws.  Further, the treatise provides textual discussions and extensive footnotes to significant decisions of the FTC and federal courts. This treatise is available online or in print and is current through 2021. Previous issues are available and can be searched by keywords. LexisNexis requires a subscription to access this content.

ABA Defending Liberty Pursing Justice, Antitrust Law Developments (8th ed.) (2017) (Bloomberg)

This treatise provides scholarly commentary, antitrust law developments, and antitrust law cases. Using this source, users can synthesize these antitrust legal material to help understand antirust law and navigate agency regulations and guidelines. This source is available in print or through Bloomberg Law. Previous editions of this treatise is available on Bloomberg Law. Bloomberg Law requires a subscription to access this content.

Additionally, this Hornbook examines policy towards collusion and joint ventures, and provides analysis of antitrust enforcement institutions. This treatise is updated periodically and there is a searchable archive of previous posts. The treatise is available in print and can be accessed through the University of Chicago Law Library or through West Publishing.

This practice guide provides antitrust basics and includes in-depth antitrust law procedures including: horizontal and vertical mergers, joint ventures, private damage actions, price fixing, predatory pricing, step-by-step reviews of FTC and DOJ antitrust investigations, the Robinson-Patman Act, and international trade law. DOJ Civil Antitrust Practice and Procedure Manual (2nd ed. 2018)

This practice guide is a handbook that provides comprehensive material on the processes and procedures governing antitrust enforcement and policymaking by the Antitrust Division of the U.S. Department of Justice. The guide provides a framework for understanding the process and procedures the Antitrust Division employed in conducting investigations, reaching decisions about civil enforcement, advocating for competition, and formulating guidance to the antitrust community. Antitrust Class Actions Handbook (2nd ed. 2018)

This handbook guides new and experienced antitrust practitioners navigating class action antitrust lawsuits. The book provides comprehensive scholarly discussions of the issues that arise before, during, and after the filing of an antitrust class action lawsuit. The handbook considers issues and challenges faced by both plaintiffs and defendants to such actions, and focuses on both evolving legal standards as well as the strategic decisions that guide these highly complex cases. Antitrust Library Guide – Georgetown University Law Library

This research guide, provided by the Williams Law Library at Georgetown University Law Center, is intended for practitioners and students researching United States antitrust law. While the guide is not comprehensive, it lists important, current, and relevant materials available in antitrust law.

MLex FTC Watch

MLex provides a newsletter that follows the actions of the Federal Trade Commission, Department of Justice, states, governments, and proposed antitrust rules and regulations. While MLex requires a subscription to access its content, the newsletter is available and free through the Washington Library Consortium. Others outside of this consortium users should check with their local library for reciprocity options. MLex FTC Watch has a Twitter account that features latests trends and updates on antitrust law.

American Bar Association Antitrust Law Journal

This Law Journal is routinely published by the American Bar Association. This Journal primarily features leading scholars and experts in the field of antitrust law.  This Journal is updated periodically and there is a searchable archive of previous posts. Users may need a subscription to the ABA to access past content that was published.

Wolters Kluwer Antitrust Law Daily

This source provides a daily report of antitrust law and gives a synopsis of updates in the area of antitrust law. This resource can be used as a guide to understanding current events and provide insights to latest regulatory practices. Previous issues are available and can be browsed or searched by keyword. PLI Plus's annual CLE handbook on Developments in Antitrust Law and Regulation

The Practicing Law Institute (PLI) annually publishes an educational supplement for antitrust law. This is a non-legal source that provides scholarship geared toward the business side of antitrust law. Economics of Regulation and Antitrust (Falvey Library on Villanova University Campus)

This book publication discusses regulation and antitrust as key components of government policy. While the book is free to access, you must be a member of the Villanova University community. The AAI provides educational lessons and resources for teachers built around antitrust cases.
